Terms & Conditions

The following Terms and Conditions govern the relationship and the rights and obligations of you ("Client") and Max Aegle Fitness ("Club").

  1. Membership ("MEMBERSHIP")
    1. Memberships are personal to the Client and are non-assignable, non-transferable and non-refundable. In exceptional circumstances a transfer may be considered at the discretion of the Club's Management, however an administration fee will apply. The Club may assign the benefit of these Terms and Conditions to any person, firm or company at any time without notice to the Client.
    2. All new memberships are subject to the approval of the management team of the Club (the "Management"). The Management reserves the right to reject an application for membership to the Club for any reason whatsoever without reasoning for such rejection being required.
    3. Upon acceptance of an application, the Client will be issued with a membership band and the Client shall be entitled to all the rights and privileges under the class of membership purchased. If a membership band is lost or misplaced, the Management will issue a replacement band at a cost of AED 100 + applicable taxes.
    4. A Client may not loan his / her membership band to a third party.
    5. Any Client wishing to enter the Club without their membership band will only be admitted at the absolute discretion of the Management.
    6. Memberships are available to individuals who are a minimum of 18 years of age. Any applicant below 18 and above 4 years of age ("Junior Client") must produce a consent form signed by their parent / guardian. All Junior Clients below 16 years of age must be accompanied and supervised by their parent / guardian at all times in the Club and Junior Clients aged 4 to 13 are only allowed to attend classes, whereas those aged 14 to 16 will be required to train in the Club with a Personal Trainer (in accordance with Clause 12 below and the Children’s Policy provided separately).
  2. Membership Fees ("MEMBERSHIP FEES")
    1. Membership Fees are non-refundable upon termination of membership in accordance with Clause 4.
    2. The Management reserves the right to periodically review the Club's prices, charges and fees and implement reviewed and amended prices accordingly without prior notice to the client.
    3. Where any fees are outstanding for a period of more than 1 month, the Management may cancel the Client's membership without notice at any time. The Management reserves the right to continue to attempt to charge the Client for all outstanding fees, termination fees and membership fees. Legal action may be taken to recover any outstanding payments from the Client. The Client may not rejoin the Club until the outstanding payments are made.
    4. Any lapse in membership will require the Client to rejoin at the Membership Fees of the prevailing pricing at the time of rejoining.
    5. All amounts payable under these Terms and Conditions shall be exclusive of value added tax or similar indirect tax ("VAT"). Where VAT is payable under these Terms and Conditions, the consideration for the supply of goods / services shall be increased by an amount equal to the amount of VAT applicable at the prevailing rate at the time such supply is made. Payment of VAT, as applicable under law, is a prerequisite under this Terms and Conditions.
    1. Membership cannot be ‘Paused'. Memberships remain active from the start date to the expiry date. Non-usage of membership, club or facilities does not affect expiry dates.
    1. Subject to Clause 4.2 below, Clients applying for Cancellation of Membership ("Cancellation") from the Club must attend an appointment with the Management to discuss exit options and financial implications of the cancellation.
    2. Cancellation of any upfront payment for Membership is not permitted and any such amounts paid are non-refundable. In exceptional circumstances, a request to transfer the remaining balance of the Membership may be considered and a new Membership and commitment period may be imposed.
    1. The Client warrants and represents that they are in good physical condition and that they know of no medical or other reason why they are not capable of engaging in an active or passive exercise program and that such exercise would not be detrimental to his / her health, safety, comfort or physical condition.
    2. It is the Client's responsibility to update the Club in writing with any information that might affect their ability to engage safely in any physical activity at the Club.
    3. The Client shall not use any Club facilities of the Club whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other clients.
    4. Clients and their guests exercise and use the facilities of the Club at their own risk and are advised to consult their physician prior to commencing any type of physical exercise.
  6. Expulsion of clients
    1. The Management may terminate the Membership of any Client without notice and with immediate effect:
      1. If a Client's conduct, whether or not such conduct is the subject of complaint by another Client, is such that in the reasonable opinion of the Management is harmful to the character and / or interests of the Club.
      2. If the Club is of an opinion that the Client has committed any breach of the Club's Rules and / or these Terms and Conditions.
      3. If a Client is rude, aggressive or in any way disrespectful in the Management's opinion to another Client or to any of the Club’s employees, this includes but is not limited to foul / bad language.
      4. If any Membership Fees or any other fees howsoever arising in respect of Personal Training etc. remain outstanding after the relevant due date for payment.
      5. If the Club is of the opinion that the Client is not a suitable individual for continued membership of the Club.
      6. If a Client is found to have violated the privacy of any other client in the changing rooms or are caught in lewd or compromising actions. This includes ignoring or disrespecting the Club's "No Nudity" policy in the changing room area.
    2. A Client whose Membership is terminated by the Management for whatsoever reason shall forfeit all the privileges of Membership with immediate effect without claim of any refund of their Membership Fees. On termination of a Client's Membership the Client will be required to settle any outstanding debts and return their membership band and any other property provided by the Club obtained as a result of Club Membership.
  7. Guests and Visitors
    1. Clients introducing guests shall ensure that their guests complete the guest registration and pay the applicable fee to obtain a Temporary Access Pass.
    2. For security reasons, all guests and visitors are required to provide a photo ID such as Emirates ID or Passport / Visa copy when visiting the Club. A copy of the identification document and / or ID number will be retained on record.
    3. A Temporary Access Pass that has been issued on a complimentary basis must be used in line with these Terms & Conditions.
    4. Clients are not permitted to use a Temporary Access Pass to gain access to the Club or use any paid facilities without charge unless authorized by Management.
    5. Guests will have the same Membership privileges as that Client who introduced them and will be subject to the same Club rules and limitations of liability as that Client. It is the responsibility of the Client introducing a guest to ensure that their guest complies with the Club's Rules and Terms and Conditions.
    6. The Management reserves the right to exclude any guest from the Club without giving any reason for doing so and change the charges levied for Temporary Access Passes from time to time without notice.
    7. Any guest or a Client or a temporary visitor to the Club shall agree to abide by the Club's Rules and these Terms and Conditions, and the same limitation of liabilities applicable to a Client shall apply to their guest.
  8. Health and Safety
    1. All Clients are required to complete the mandatory ‘introduction' session before commencing their exercise programme with one of the Club's Personal Trainers.
    2. Clients should be considerate of other Clients of the Club by using their workout towel when using any of the exercise stations and Clients should wipe down all equipment with the hygienic wipes after use.
    3. Clients are requested to return all equipment after use to the racks provided.
    4. The Client should seek instruction from the Club's staff before using unfamiliar equipment.
    5. All Club employees are authorized to stop anyone from exercising if in their opinion that person is exercising in a manner that may result in personal injury to themselves or others. Clients must abide by the guidance of the Club's staff and comply with all points clearly stated on the ‘Club Rules' notice.
    6. Personal Training sessions must be completed on or before the stated expiry date. Extension to this date requires authorization from the Fitness Experience Manager.
    7. Smoking is not permitted in any part of the Club.
    8. In the interests of health and hygiene, Clients and their guests are requested to shower prior to entering the Swimming Pool.
    9. Clients may not use the facilities of the Club whilst under the influence of alcohol, narcotics or other mood-altering substances.
    10. Games or activities which are disturbing or dangerous to others are not permitted. Sound equipment such as radios are not permitted except with the use of headphones.
  9. Operating Hours
    1. The Club's normal hours of operation are indicated at the Club's entrance and on the website. The Management reserves the right to adjust the hours of operation at any time without notice. The Management shall however try to give reasonable notice of any change in the hours of operation to Clients.
    2. Last admission will be allowed 1 hour and 30 minutes before closing and the Client is requested to leave the Club premises punctually prior to the time of closing.
  10. Dress Code
    1. All Clients are required to wear proper gym attire when exercising and to dress modestly when working out; short workout tops that expose the midriff are not permitted. No torn clothes, jeans, denim shorts or hats are permitted. Closed toe, non-marking, rubber-soled sports shoes are required to be worn at all times in the gymnasium and in the Group Experience Studios. Clients should remain modestly and appropriately dressed at all times, including in the changing area. Public nudity is not permitted, and Clients are requested to use the private changing cubicles provided.
  11. Club Facilities
    1. The Management accepts no responsibility for any loss or damage to a Client's personal belongings, whether in the lockers or otherwise. All items of the Client are brought into the Club at the Client’s own risk.
    2. The use of mobile phones with camera features and / or any other types of visual recording devices are strictly prohibited to be used in the changing rooms. Clients breaching this rule will be handed over to the authorities to be dealt with accordingly.
    3. Certain complimentary drinks may be provided to Clients and where provided are for consumption within the Clubs' premises only. Clients are not allowed to bring their own food and / or drinks into the Club.
    4. The Management may from time to time show potential Clients or others around the Club and allow them to use the Club's facilities on a trial basis and reserves the right to do so.
  12. Personal Training
    1. Personal Training can only be conducted by the Club's employed and certified trainers ("Personal Trainer/ PT").
    2. Clients must sign a Personal Trainer Agreement prior to commencement of any Personal Training Sessions. The Personal Trainer must acknowledge the session is conducted via the MindBody™ system. Personal Training sessions and agreements are subject to verification / audit without notice.
    3. The Club reserves the right to provide a replacement qualified Personal Trainer in the event that the current Personal Trainer is not available (this will be at the Management's discretion).
    4. Notice of cancellation of PT sessions must be given at least 24 hours in advance of the scheduled appointment time. Sessions will be deemed used within 24 hours of the scheduled appointment. Failure to attend a scheduled PT session without notice will result in the session being fully charged.
    5. All PT sessions purchased are non-refundable and non-transferable.
    6. Any specialized coaching and training that takes place at the Club's premises can only be conducted by the Club's employed and qualified trainers or officially appointed third parties.
  13. Group Experience
    1. Clients must register with the Club at least 30 minutes prior to the start of every Group Experience Class.
    2. Clients booking classes via the Club's website or mobile app and failing to attend shall be given a limit of 3 ‘no attendances' within a specified period. If the Client exceeds 3 ‘no attendances' the Management reserves the right to deny that Client the right to book or attend Group Experience Classes for a period of time, such period is at the Management's discretion.
    3. Clients are not allowed to enter a studio 10 minutes after a class has started.
    4. Any Client not present in a studio at the scheduled class start time forfeits their space in that Class and the Club reserves the right to give that Client's space to another person.
    5. Clients are asked to refrain from using mobile phones in all Group Experience Classes.
    6. Clients must use appropriate closed toe, non-marking, rubber-soled sports shoes when participating in all Group Experience Classes.
    7. Clients can attend any class anytime, however back to back classes are discouraged to allow other Clients to enter.
    8. For hygiene reasons, Clients are advised to use towels in all Group Experience Classes.
    9. Group Experience Classes may be free of charge dependent on Membership Category. The Club does however reserve the right to apply a fee. Where a fee will apply, this will be specified on the Group Experience Class timetable.
    10. Clients must not use the studio audio systems unless permission has been granted from the Group Experience Manager.
    11. Any advance payments towards Fitness or Group Experience Classes, Studio usage or any other payable activities, will not be refundable or transferable.
  14. Swimming Pool Area
    1. For reasons of health, safety and hygiene clients must:
      1. Always shower before entering the swimming pool.
      2. Not consume, store, or bring into the changing rooms or swimming pool area, any food or drink or any kind of glass container.
      3. Only shave in the wash basins provided.
      4. Not use the swimming pool while under the influence of alcohol, anticoagulants, antihistamines, beta—blockers, narcotics or tranquilizers. If you have high or low blood pressure, heart disease, cardiac irregularities, asthma and / or diabetes, or if you are pregnant you should consult your doctor prior to using the Club facilities.
    2. Clients should use the Club's facilities in moderation and under medical advice.
  15. Lockers
    1. The Club will provide temporary Lockers and Clients must clear their property from the Lockers before the Club closes. Unclaimed property will be kept by the Club for a period of 1 week after which the Management reserves the right to dispose of the property in any way it sees fit.
    2. Money or valuables should not be kept in the Lockers. The Club does not take any responsibility for items kept in the Lockers and cannot be held responsible for any loss or damages to such items. The Client leaves such items in the Lockers at their own risk.
    3. If a Client loses or damages a Locker's key / lock the Client will be responsible to pay a fee to replace the key and / or lock if necessary.
    4. Private Lockers may be available for rent at the prevailing monthly rate which may change from time to time at the Management's discretion. Lockers are non-transferable.
    5. Extension of locker rental must be paid at reception prior to a locker rental expiry. If property is left in the Locker for 1 week after the locker rental expires, the Management reserves the right to empty the Locker and deal with the contents accordingly.
    6. Where a band or Temporary Access Pass is issued it remains the property of the Club and must be returned upon termination of the locker rental or termination of membership. In the event of loss, a penalty fee will be charged.
  16. Others
    1. Soliciting and selling private personal training sessions or merchandise of any type to any of the Club's Clients is prohibited and shall result in immediate termination of the concerned Client's Membership.
    2. The Management reserves the right to use any individual or group photographs of Clients and / or guests for press or promotional purposes.
    3. All Clients must abide by the Rules of the Club and these Terms and Conditions which may be amended and / or added to from time to time at the Management's discretion without notice.
    4. All branding, designs, logos and Club interiors are protected by intellectual property rights. Clients and / or guests are not allowed to photograph or copy the Club's interior designs, promotional materials, tag lines, themes or concepts. The Club reserves the right to proceed with legal action against any Client caught distributing, sharing or supplying such contents to any third party or competitor.
    5. Any failure or delay by the Club in exercising any right, power or privilege under these Terms and Conditions will not operate as a waiver of any such rights, powers or privileges nor will any single or partial exercise of any right, power or privilege by the Club preclude any further exercise thereof or the exercise of any other right, power or privilege.
    6. Termination of a Client's Membership and / or these Terms and Conditions shall not affect any accrued rights or remedies to which the Club is entitled.
    7. If any provision of these Terms and Conditions is held to be invalid or unenforceable, that provision shall (so far as it is invalid or unenforceable) be given no effect and shall be deemed not to be included in this Agreement but shall not invalidate any other provision in this Agreement.
    8. These Terms and Conditions (as amended from time to time) and the Club's Rules (as amended from time to time) constitute the whole agreement between the Club and Client. A Client may not vary any of the Terms and Conditions or the Club's Rules for any reason whatsoever.
  17. Limitation of Liability
    1. In consideration of the Management accepting the Client's application for Membership of the Club and for the Client to become and remain a Client of the Club, the Client agrees that:
      1. The Club accepts no responsibility for loss, for damage to Clients' or their guests' property, for death or injuries sustained while on the Club's premises. Clients agree that no such claims will be made against the Club, the Management or staff of the Club for any reason whatsoever.
      2. The Club, its associated companies, employees or agents shall not be responsible for any claims, demands, injuries, damages or actions for negligence arising on account of death or due to injury, loss, damage or theft to Client's personal property arising out of or in connection with the use by a Client of any of the services, facilities on the premises of the Club. The Client hereby holds the Club, its associated companies, employees and agents harmless from all claims as mentioned in this Clause 17 which may be brought against them by or on a Client's behalf.
